End User License Agreement

This End User License Agreement ("EULA") is between you and Rustalytics ("we", "us", "our") and governs your installation and use of the Rustalytics software — including the desktop application, the hosted Pro web app at rustalytics.com/app, the Rustalytics Discord bot, the browser extension, and any other software we make available (the "Software").

By installing, downloading, copying, or otherwise using the Software, you accept this EULA. If you don't accept it, don't install or use the Software. This EULA is in addition to our Terms of Service and our Privacy Policy; where they overlap, the Terms of Service govern.

Your Rustalytics licence is tied to the Steam account you used when you signed in. It is not transferable.

1. Licence grant and scope

Subject to your compliance with this EULA and the Terms of Service, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the Software on devices you own or control, solely for your own non-commercial use as a player of Rust.

This licence covers ordinary updates to the Software unless an update is shipped with its own separate licence terms. You are not entitled to any specific update or feature.

You may make a reasonable number of backup copies of the desktop installer for your own use, provided they remain unmodified and contain all original notices.

2. Restrictions

You may not, and may not permit anyone else to:

  • Sell, rent, lease, sublicense, distribute, or otherwise commercially exploit the Software, the Rustalytics service, or any data accessed through them.
  • Reverse engineer, decompile, disassemble, modify, translate, or create derivative works of the Software, except to the extent that this restriction is prohibited by mandatory law.
  • Remove, alter, or obscure any copyright, trademark, or proprietary notice.
  • Share your Rust+ auth token, FCM credentials, Rustalytics account, or paid subscription with anyone else.
  • Use the Software to access another player's account, or to act on behalf of someone who has not authorised you.
  • Use the Software to violate any law, the Terms of Service, Facepunch's Rust+ rules, the Steam Subscriber Agreement, Discord's terms, or the rules of any specific Rust server.

Violations of this section terminate your licence immediately and may result in suspension of your Rustalytics account.

3. Technical requirements and updates

The desktop application currently runs on recent versions of Windows; macOS and Linux builds may be offered. The Software requires an active internet connection and depends on the availability of the Rust+ companion API operated by Facepunch and other third-party services. We may update or change requirements over time; we are not obliged to support any specific operating-system version, hardware configuration, or runtime version.

The Software may automatically check for updates and download or apply them. You consent to such updates as part of using the Software.

4. Compliance with Facepunch and server rules

Rustalytics is a third-party companion. It is not made by, endorsed by, or affiliated with Facepunch Studios. The Software talks to Rust only through Facepunch's official Rust+ companion API — it does not modify the Rust client or hook into game memory.

Facepunch's published position on third-party Rust+ tooling is in the "R.U.S.T" Rust devblog of 4 May 2023: "Automation of game input actions must be kept to a minimum using Rust+. Extensive automation of game actions such as CCTV cameras and Drones to gain an unfair advantage is not ok." The Software is built around that line — it does not automate any in-game player input, does not use the Rust+ camera feed, and does not control drones. Individual Rust servers can still have stricter rules, and you're responsible for reading and following the rules of every server you play on.

If you use the Software to violate Facepunch's rules, the Steam Subscriber Agreement, a server's rules, or any law, your licence ends immediately and we may suspend or terminate your Rustalytics account without notice or refund. We are not responsible for any in-game ban, server ban, EAC ban, Steam suspension, item loss, or other consequence of how you use the Software.

5. Use of data

To operate, the Software collects and transmits the data described in our Privacy Policy — including your Steam64 ID, Rust+ auth token, FCM push credentials, smart-device pairing data, in-game and Discord chat messages on connected servers, settings, and Stripe payment identifiers. By using the Software you agree to those processing activities.

We may collect technical diagnostic data (crashes, performance metrics, error logs) to improve the Software. Where this data may identify you, it is treated as personal data under the Privacy Policy.

6. Third-party components

The Software includes or depends on third-party software components, including but not limited to Electron, Node.js, Chromium, the Rust+ companion API, Google Firebase Cloud Messaging, Discord, Stripe, and various open-source libraries. Those components are governed by their own licences. Where required, the relevant notices are included in the Software distribution. Open-source notices are available on request from legal@rustalytics.com.

7. Warranty

We warrant that the Software, in the form distributed by us, is free from malware as of the moment we publish it. We use industry-standard practices and code-signing where available.

Otherwise the Software is provided "AS IS" and "AS AVAILABLE". To the fullest extent permitted by law, we disclaim all other warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that smart-alarm fires, raid pings, command answers, timers, or any other output will be accurate, timely, or delivered at all.

This section does not exclude warranties or rights that cannot lawfully be excluded — in particular, mandatory consumer rights under EU/Swedish law.

Please report any apparent issue with the Software within a reasonable time of discovery so we can investigate.

8. Liability

To the maximum extent permitted by law, our liability arising out of or related to this EULA or the Software is limited as set out in the Terms of Service. In particular, we are not liable for indirect or consequential damages, lost profits, lost data, or any in-game loss, including loss caused by a server ban, EAC ban, raid, or wipe. Nothing in this EULA limits liability that cannot lawfully be limited (gross negligence, intentional misconduct, or bodily injury caused by our negligence).

You are responsible for backing up any local data the desktop application stores on your device. We are not liable for loss or corruption of that data.

9. Termination

This licence stays in effect until terminated. It terminates automatically if you breach this EULA or the Terms of Service. We may also terminate it on reasonable notice, including for the reasons described in our Terms of Service.

On termination you must stop using the Software, uninstall it from your devices, and delete any copies. Sections that by their nature should survive termination (intellectual property, restrictions, warranty disclaimers, liability limits, governing law) will survive.

10. Sunset clause

If maintaining the hosted infrastructure becomes economically or technically unviable, we may discontinue server-side features. Where possible we will release a desktop-only update so the local features keep working, refund any prepaid period we will no longer deliver, and give reasonable notice in the app and on Discord.

11. Export and sanctions

You confirm that you are not located in, and are not a national or resident of, any country subject to a comprehensive trade embargo by the European Union, Sweden, the United Kingdom, or the United States, and that you are not on any list of restricted parties published by those authorities.

12. Intellectual property

The Software, the Rustalytics name, and the Rustalytics logo are owned by Rustalytics or our licensors. All rights not expressly granted in this EULA are reserved. "Rust" and "Rust+" are trademarks of Facepunch Studios; we use them only to describe the game we integrate with.

13. Governing law

This EULA is governed by the laws of Sweden, excluding its conflict-of-laws principles. Disputes are handled as described in the Terms of Service. If any part of this EULA is found unenforceable, the remainder stays in effect and the unenforceable part will be replaced by an enforceable one closest to its original intent.
